Under Atkins, states may not impose the death penalty against those who are intellectually disabled. Hamm v. Smith is a case about how to determine intellectual disability. Do you consider just IQ tests? The point estimates or the confidence intervals? Can you consider other information? The case has a complicated history—this is its second time before the Court—and is outside of my area, so just the predictions in this report.
The Eleventh Circuit upheld a district court’s decision to throw out the death sentence. The model predicts the Court will reverse, on a conventional 6-3 basis.
